GENERAL RENTAL TERMS AND CONDITIONS – GLOBE DRIVE
The rental of the vehicle indicated on page 1 is subject to the present general terms and conditions and the following articles, fully accepted without reservation by the Renter.
Article 1: Use of the Vehicle
The Renter undertakes to strictly comply with the following conditions:
A) Only the Renter is authorized to drive the vehicle. The Renter is fully responsible for it and agrees to use it solely for personal purposes. Overloading the vehicle or carrying a number of passengers exceeding that stated on the vehicle registration card is strictly prohibited.
B) The Renter agrees to comply with the Highway Code and never exceed the maximum speed of 110 km/h.
C) The Renter agrees not to exceed 250 kilometers per day.
D) Driving the vehicle under the influence of alcohol, drugs, or in case of illness or fatigue affecting driving ability is strictly prohibited.
E) Driving the vehicle on tracks or unpaved roads is strictly prohibited.
F) Transporting dangerous, flammable, or illegal goods is strictly prohibited.
Article 2: Insurance
Duration: Insurance coverage is valid only for the rental period or any extension expressly approved by GLOBE DRIVE.
Coverage:
A) Bodily injury to third parties / free passengers.
B) Fire (except in cases of gross negligence).
C) Accidents subject to a deductible of 8% of the vehicle’s value, payable by the Renter.
Exclusions:
A) Accidents occurring after the rental period has expired.
B) Luggage and personal belongings.
C) Damage caused on tracks or due to improper handling.
D) Accidents occurring while under the influence of alcohol or drugs.
E) Damage to headlights, bumpers, paint, windows, and loss of equipment (keys, documents, radio).
F) Towing costs.
Article 3: Accidents
A) Any accident or fire must be reported in writing to GLOBE DRIVE within 24 hours and declared to the authorities (Police/National Guard). An accident report is mandatory.
B) Failure to comply results in loss of insurance coverage and full billing of damages. The contract remains valid with a 30% surcharge.
C) The declaration must specify the circumstances, date, time, and place of the incident.
D) The police report must be attached.
E) Any settlement with third parties is strictly prohibited.
F) GLOBE DRIVE declines all responsibility in case of false information provided by the Renter.
Article 4: Fuel and Oil
Fuel is at the Renter’s expense. The vehicle must be returned with the same fuel level as at delivery. The Renter must check oil and water levels. No refund will be made for remaining fuel.
Article 5: Vehicle Condition
A) The vehicle is delivered in perfect condition.
B) It must be returned in the same condition; otherwise, cleaning and/or repair costs will be charged.
C) All five tires must be returned in good condition (immediate replacement or payment required in case of damage).
Article 7: Circulation
The vehicle may be used exclusively within the territory of the Republic of Tunisia. Leaving the country without written authorization from GLOBE DRIVE is strictly prohibited.
Article 8: Rental – Deposit – Extension
A) The security deposit may not be used as a rental extension.
B) Any extension must be approved and paid in advance, failing which legal action may be taken.
Article 9: Vehicle Return
A) Late return: 30% surcharge on the daily rental rate.
B) Additional fees apply if the vehicle is returned to a location different from the pickup point.
C) GLOBE DRIVE assumes no responsibility for forgotten items.
Article 10: Documents
A) All vehicle documents (registration card, etc.) must be returned. The rental remains active until all documents are returned.
B) In case of loss, replacement costs are borne by the Renter.
Article 11: Penalties
A) Excess mileage (over 250 km/day): 500 millimes per extra kilometer.
B) The Renter is fully responsible for all fines and traffic violations.
Article 12: Legal Jurisdiction
A) In case of non-payment, legal and court fees shall be borne by the Renter.
B) The competent court is Bizerte.
